Comprehensive Eviction Appeal Services

An eviction appeal allows either party to seek a higher court’s review of the original eviction ruling, providing a fresh opportunity to present evidence and argue the case. For landlords, an appeal can be essential to securing possession of the property and recovering past-due rent. At Evict Your Tenant, we provide expert legal assistance to help you navigate the complex appeal process and safeguard your investment.

In Texas, appeals from Justice Court are considered a “trial de novo,” or a completely new trial. This means that any evidence or testimony previously presented does not carry over; everything must be submitted anew in County Court. Trials in the County Court follow stricter rules, including the Texas Rules of Civil Procedure and the Texas Rules of Evidence. Our experienced team ensures that your case is handled with precision and professionalism at every stage.

How to File an Eviction Appeal

To appeal a judgment in an eviction case, a party must act quickly and take one of the following steps within five days after the judgment is signed:

f a tenant fails to meet these requirements, the appeal is not perfected, allowing the landlord to obtain a Writ of Possession. However, if the appeal is perfected, the case is transferred to County Court for a new trial.

At Evict Your Tenant, we provide the guidance and support necessary to file a proper appeal, ensuring all deadlines and procedural requirements are met to protect your rights as a landlord.

The County Court Process

Once in County Court, the eviction appeal becomes a full retrial. The County Court Judge will review all evidence and testimony presented during the trial, which must comply with the Texas Rules of Civil Procedure, Texas Rules of Evidence, and local court rules. After the trial, the Court will issue a final ruling.

If the ruling is in favor of the landlord, you may obtain a Writ of Possession to regain control of your property. Additionally, landlords may be entitled to recover past-due rent up to the date of the trial, as well as court costs and attorney’s fees. Our team at Evict Your Tenant works diligently to represent your interests and help you achieve a favorable outcome in County Court.

Testimonials

Tom Huynh assisted me in being the executor of my brother’s estate, even though I did not live in Texas. It was not a straight forward process as my brother and I were estranged, I had lost contact with him for many years. During those years my brother became confused and at the time of his death was living on the street. Tom did a wonderful job guiding the steps through the court system to resolve the estate. He went above and beyond just being helpful. He spent hours helping with reaching people, I was too far away to reach, to bring the estate to a resolution. I would use him again in a minute! I just wish he lived in my state!
